I, Councillor Mike McCusker, Lead Member for Planning, Transport & Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby approve:
The addition of the property Cleveland House, 224 Eccles Old Road to the local list of heritage assets.
The property is considered to be a good example of a Victorian villa built for the wealthy merchants of the city and also has an unusual tower/turret feature to the rear. Former residents William Hinmers and James Higson were both Justices of the Peace with James Higson also being a Salford Councillor. When its use as a residential dwelling ceased Cleveland House became a nursing home for the residents of the city. The property is therefore considered to have good architectural value and strong historical associations to the city and as such is worthy of inclusion on the local list of heritage assets.
Options considered and rejected were:
That the property was not added to the local list of heritage assets. This was rejected as the property was considered to have both architectural and historic local value.
Low – inclusion on the local list does not affect the requirement for planning permission but rather becomes a material consideration for any proposal requiring planning permission. This does not necessarily mean that planning permission will be refused; it may simply require additional consideration of the design of the proposal.

Legal issues have been considered within the body of the report. A local list is a non-statutory discretionary function of the Council. Any decision to add/remove a heritage asset to/from the local list would have the potential to be subject to judicial review on the normal grounds.
