I, Councillor McCusker, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:

 

(i) accede to the objections in part;

(ii) approve the modifications to the scheme as set out in this report; and

(iii) authorise the making of the Traffic Regulation Order in the modified form.

 

City of Salford (Glenmuir Close, Irlam) (Prohibition of Waiting) Order 2021

 

The Reasons are:

That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Orders to introduce: ‘City of Salford (Glenmuir Close, Irlam) (Prohibition of Waiting) Order 2021’ on Glenmuir Close at its junction with B5320 Liverpool Road and around the bend to keep the area and sole footway clear of parked vehicles, improving accessibility and visibility to the area.

 

Assessment of Risk:

The restrictions will be marked out in accordance with the Traffic Signs Manual and Traffic Sign Regulations and General Directions. (TSRGD 2016).

 

Legal Advice obtained: 

Where objections are received by the Council following the advertisement of proposals, the decision regarding the implementation of the proposals is delegated to the relevant Lead Member for determination. Adhering to this procedure should not give rise to any legal implications.

Under regulation 14 (1) of The Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations 1996(“the Regulations”) an order making authority may modify an order, whether in consequence of any objections or otherwise, before it is made.

The modifications relate to a reduction in the NWAAT restrictions and as such is considered a minor amendment and thus compliance with by paragraph (4) of the Regulations is not required.

The decision to implement the proposals in this report, should not give rise to any legal implications provided the works are carried out in accordance with the appropriate statutory requirements set out in the Road Traffic Regulation Act 1984.

 

Financial Advice obtained:     

The cost of the proposed scheme will be met from the approved Highways Block 3 Devolved Capital allocation for Irlam & Cadishead Community Committee, in the 2021-22 financial year.
