City of Salford (Meadow Road Area, Salford) (Prohibition of Waiting) Order 2022
I, Councillor McCusker, Lead Member for Planning, Transport & Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:
(i) accede to the objections in part; and
(ii) approve the modifications to the scheme as set out in the report; and
(iii) authorise the making of the Traffic Regulation Order in the modified form.
The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce CITY OF SALFORD (MEADOW ROAD AREA, SALFORD) (PROHIBITION OF WAITING) ORDER 2022.
Options considered and rejected were: Implementation of the original scheme. The scheme has been modified in response to objections received, as set out in the report.
Assessment of Risk: Implementation of the restrictions would help maintain a high level of road safety,
· By preventing inconsiderate and obstructive parking on or close to junction, impacting safe access and egress and passage of pedestrians at pedestrian crossing points. By blocking dropped crossing points and reducing / blocking visibility of approaching traffic.
· Proposals will ensure junctions have a suitable amount of clear visibility, and that service and emergency vehicles will be able to access the estate at all times.
· The proposals will also ensure there is sufficient access for pedestrian to cross safely at dropped pedestrian access points and maintaining a suitable amount of clear visibility to see approaching vehicles.
The source of funding is: The scheme is being promoted by the developer.
Legal Advice obtained: The Council, by virtue of the Road Traffic Regulation Act 1984 can introduce orders to manage traffic. Where Traffic Regulation Orders are required, they should not give rise to any particular legal implications provided the works and procedures are carried out in accordance with the relevant statutory requirements, which would include the consideration of any objections to a proposed TRO.
