Decision: Salford City Council - Record of Decision
I Councillor Tracy Kelly, Deputy City Mayor, in exercise of the powers contained within the City Council Constitution do hereby approve:
1. Note the update on the City Region Sustainable Transport Settlement funding.
The reasons are that the that the City Region Sustainable Transport Settlement funding programme will allow for the continued delivery of maintenance and improvements to Salford’s transport network. This includes specific strategic maintenance priorities and an ongoing programme of maintenance projects.
High: The process of setting budgets for the CRSTS funding settlement which took place over a number of years means that inflationary pressures in the construction sector have increased substantially since the funding allocations were bid for and agreed. The government funding letter to Greater Manchester confirms ‘Any cost overruns must be met locally and no additional HMG funding from this settlement will be provided to support your CRSTS programmes’. This means that the work funded by the programme will have to be reduced in scope as inflation pressures and other delivery challenges highlighted in the report continues to erode what can be delivered with the funding allocated through this process.

Decision: Salford City Council - Record of Decision
Revision Of Rental and Disposal Charges for Gardens, Garage Sites and Minor Rights of Way/Access Agreements
I, Councillor Tracy Kelly, Deputy City Mayor, in exercise of the powers contained within the City Council constitution do hereby:
1. Approve the proposed revision of rental charges as follows:
based upon plot size.
are to be phased in over a two-year period.
2. Approve the proposed revision of the basic disposal rate for garden tenancies from £16 per square metre to a minimum of £35 per square metre.
3. Approve Future disposals to be based on the grant of 125 year-long leasehold interests.
4. Approve The proposed increase of administrative charges to £75 for new lettings and £250 for disposals.
5. Note and approve the intention to move all existing garden tenancies agreements onto the current standard garden lettings terms document.
6. Note the proposal to revise rental and sales figures every 5 years, and which will be the subject of future reports to the Deputy City Mayor.
The Reasons are that the proposals introduce new rental and disposal charges for gardens, garage sites and minor rights of way/access located throughout the City. The former Management Services Committee approved the current scale of charges in 1995. Since that time, disposal and rental charges have fallen well behind open market values and there is now a need for a fundamental review of the charging arrangements. Comparable evidence to support the proposal has been gathered following investigations with local authorities.
Source of funding: The proposals will generate additional rental income for the City Council reflecting the current value of the assets.

Decision: Salford City Council - Record of Decision
I, Councillor Tracy Kelly, Deputy City Mayor, in exercise of the powers contained within the City Council constitution do hereby:
1.Approve the disposal of the 104 properties across the three sites to Dérive RP for a term of 999 years.
2. Approve the lending of £6,676,991 to Dérive RP to fund the acquisition and associated costs.
3. Grant delegated authority to the Strategic Director Place in conjunction with the S151 officer to negotiate, agree, and finalise the detailed terms of the transaction.
4. Approve and enter into the intragroup agreement (previously referred to as the amended Shareholders agreement) between the City Council (as shareholder) and the Dérive companies.
5. Authorise the Shared Legal Service to prepare all necessary documentation and to take all steps which are required to give effect to the above recommendations.
The Reasons are that Cabinet approved the disposal of the first 104 affordable homes being developed by the council to Dérive RP, subject to Dérive RP being registered as a Registered Provider, and the associated lending of monies to Dérive RP for the acquisition of the affordable homes. It also approved entering into a Shareholders agreement setting out the relationship between the City Council (as shareholder) and the Dérive companies.
Following the registration of Dérive RP with the Regulator of Social Housing the above approvals allow for these proposals to be delivered
Source of funding: There are sufficient capital allowances in the programme to cover the cost of purchase of these schemes. Dérive RP has a fully viable business plan to support the transfer of these properties with a pay-back period of loan to the Council of 40years. This business plan shows an operating surplus of in excess of £4m at year 40 with no need for working capital from the council at any time in between.
