Decision:

Salford City Council - Record of Decision

 

I, Councillor Kelly, Lead Member for Housing and Neighbourhoods, in exercise of the powers contained within the Council Constitution, do hereby approve:

 

1.    That, the Strategic Director Place be authorised to instruct Urban Vision to continue negotiations with the owner of 32 Peel Green Road, Eccles, M30 7AJ, to acquire the Order Lands by agreement prior to confirmation of the compulsory purchase order and the coming into force of the General Vesting Declaration, and that any request for purchase in advance of the compulsory purchase in advance of the compulsory purchase order from the landowner be dealt with expeditiously.    

 

2.    That the Strategic Director Place be authorised to instruct Legal Services to proceed with the making of a compulsory purchase order under Section 17(1)(b) of the Housing Act 1985, and the Acquisition of Land Act 1981 to acquire 32 Peel Green Road, Eccles, M30 7AJ for housing purposes should negotiations to acquire by agreement fail and formally declare the area shown on the plan in Appendix 1 to be the ‘City of Salford (32 Peel Green Road, Eccles, M30 7AJ) Compulsory Purchase Order 2018’.   

 

3.    That the Strategic Director Place be authorised to make, if necessary, minor technical amendments to the compulsory purchase order boundary as shown on the plan in Appendix 1.

 

4.    That the Strategic Director Place be authorised to instruct the City Solicitor to deal with the order and to take all necessary steps, including the publication of statutory notices, to secure confirmation of the order by the Secretary of State for Communities and Local Government and the vesting of the land in the City Council.

 

5.    That, the Strategic Director Place be authorised to instruct Urban Vision, in consultation with the City Solicitor, to agree the subsequent disposal of the property, for market value and on condition that the property is renovated within a a specified time.

 

6.    That the Strategic Director Place be authorised (in the event that the Secretary of State notifies the Council that it has been given the power to confirm the Order) to confirm the Order, if satisfied that it is appropriate to do so. 

 

7.    The Deputy City Mayor (Property) notes the contents of this report. 

 

The Reasons are that:

 

32 Peel Green Road, Eccles, M30 7AJ is a defective long term empty property, constructed at circ. Pre- 1900s. It is a four bedroom, three-storey, mid terrace property that is situated in a row of residential properties, Peel Green Road. Peel Green Road is a main road which provides easy access to the Trafford Centre and is situated within the Barton ward. The property has been empty since 2009.

 

The dwelling comprises of a hallway, open plan front and rear living rooms, and a small kitchen to the ground floor and to the first floor there are two bedrooms and a bathroom, there is a second floor providing two attic bedrooms.
