I, Councillor Antrobus, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby authorise the making of the below mentioned Experimental Traffic Regulation Order permanent following the introduction of the restrictions on an experimental basis and as set out in the report.

The Reasons are:

A traffic management scheme has been implemented, introducing parking and waiting restrictions, in the vicinity of Salford City FC football ground. The measures are required to maintain access at all times, but especially on Match Days where safe access and egress in to out of the area is essential, for all vehicles including public service vehicles and emergency services.

 

Assessment of Risk:

The restrictions decrease the risk of collisions and improve access and road safety.

 

The source of funding is from:

Salford City FC as part of the planning consent  for the stadium development.

 

Legal Advice obtained:

The Experimental Traffic Regulation Orders were modified in accordance with section10(2) Road Traffic Regulation Act 1984.

 

Under Section 23 of the Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 (“the Regulations”) the Experimental Traffic Regulation Orders can be made permanent.

 

If the decision is made to give permanent effect to the experimental orders in this report, these should not give rise to any legal implications provided the works are carried out in accordance with the appropriate statutory requirements set out in the Road Traffic Regulation Act 1984

Salford City Council - Record of Decision

 

I, Councillor Antrobus, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:

 

Overrule the objections and authorise the making of the Traffic Regulation Order in respect of Rigby Street and Maplewood Court, in the form given in the Notice of Proposals as set out in the Report.

 

The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce ‘No Waiting at Any Time’ restrictions on Rigby Street to maintain vehicles and pedestrian safety at the junctions.

 

Assessment of Risk: Implementation of the restrictions would decrease the risk of collisions and improve access.

 

The source of funding: to be met from the Block 3 Highways Capital allocation of the East Salford devolved budget from the 2018/19 financial year.

 

Legal Advice obtained: Where objections are received by the Council following the advertisement of proposals, the decision regarding the implementation of the proposals is delegated to the relevant Lead Member for determination, following consultation with the Council’s Traffic Advisory Panel.  Adhering to this procedure should not give rise to any legal implications.

The decision to implement the proposals in this report, should not give rise to any legal implications provided the works are carried out in accordance with the appropriate statutory requirements set out in the Road Traffic Regulation Act 1984.

 

Financial Advice obtained: The costs will be met from the East Salford Highways Devolved Budget Capital for year 2018-2019 as approved in Delegated Decision Notice on 31.01.2019.

I, Councillor Antrobus, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution do hereby:

 

1.    accede to the objection in part;

2.    approve the modified proposals for the May Street – Anson Street ‘No Waiting at Any Time’ restriction set out in this report; and

3.    authorise the making of the May Street – Anson Street Traffic Regulation Order City of Salford (Anson Street and May Street, Salford) (Prohibition Of Waiting) Order 2019 in the modified form.

 

The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce ‘No Waiting at Any Time’ restrictions on May Street and Anson Street to maintain pedestrian safety at the junction.

 

Assessment of Risk: Implementation of the restrictions would decrease the risk of collisions and improve access.

 

The source of funding: to be met from the Block 3 Highways Capital allocation of the Eccles devolved budget from the 2018/19 financial year.

 

Legal Advice obtained: Regulation 14 of The Local Authorities’ Traffic Orders (Procedure)(England and Wales) Regulations 1996 provides that an order making authority may modify an order whether in consequence of any objections or otherwise before it is made.  Where the modification is a ‘substantial change’ the authority must inform the persons likely to be affected by the modifications and consider any representations. The modified proposals are not considered a ‘substantial change’ in the context of the overall scale and purpose of the scheme.
