Salford City Council - Record of Decision

I, Councillor Derek Antrobus, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:

1.    accede to the objection in part;

2.    approve the modified proposals for the ‘No Waiting at Any Time’ restrictions on Kirkman Avenue, Darwell Avenue and Barton Road set out in this report; and

3.    authorise the making of the Kirkman Avenue, Darwell Avenue and Barton Lane Traffic Regulation Order CITY OF SALFORD (DARWELL AVENUE, KIRKMAN AVENUE AND BARTON ROAD, BARTON) (PROHIBITION OF WAITING) ORDER 2019 in the modified form.

The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce ‘No Waiting at Any Time’ restrictions on Kirkman Avenue, Darwell Avenue and Barton Road to maintain pedestrian safety at the junction.

Assessment of Risk: Implementation of the restrictions would decrease the risk of collisions and improve access.

The source of funding: to be met from the Block 3 Highways Capital allocation of the Eccles devolved budget from the 2018/19 financial year.

Legal Advice obtained: Where objections are received by the Council following the advertisement of proposals, the decision regarding the implementation of the proposals is delegated to the relevant Lead Member for determination, following consultation with the Council’s Traffic Advisory Panel. Adhering to this procedure should not give rise to any legal implications.

The Local Authorities’ Traffic Order Procedure Regulations 1996 provide that an order-making authority may modify an order in consequence of any objection or otherwise before it is made. If the modification constitutes a substantial change, the order-making authority shall give persons likely to be affected by the modifications the opportunity to make representations. In the context of the proposed modification to the order, it is not considered that the modification set out in the report constitutes a substantial change.  If the decision is made to implement the proposals in this report, this should not give rise to any legal implications provided the works are carried out in accordance with the appropriate statutory requirements, including the Road Traffic Regulation Act 1984.

I, Councillor Derek Antrobus, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:

Overrule the objection and authorise the making of the Traffic Regulation Order in the form given in the Notice of Proposals – City Of Salford (Hallsworth Road, Winton) (Prohibition of Waiting) Order 2019

The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce ‘No Waiting at Any Time’ restrictions on Hallsworth Road to help refuse collection vehicles emptying the bins as well as improving access for other large vehicles making deliveries, collections or emergencies at the block of flats.

Assessment of Risk: Implementation of the restrictions would decrease the risk of collisions and improve access.

The source of funding: to be met from the Block 3 Highways Capital allocation of the Eccles devolved budget from the 2018/19 financial year.

Legal Advice obtained: It is necessary to consider the provisions of the Equality Act 2010 in relation to the objection.

Where objections are received by the Council following the advertisement of proposals, the decision regarding the implementation of the proposals is delegated to the relevant Lead Member for determination, following consultation with the Council’s Traffic Advisory Panel.  Adhering to this procedure should not give rise to any legal implications.

The decision to implement the proposals in this report, should not give rise to any legal implications provided the works are carried out in accordance with the appropriate statutory requirements set out in the Road Traffic Regulation Act 1984.

Financial Advice obtained: The costs will be met from the Eccles Highways Devolved Budget Capital for year 2018-2019 as approved in Delegated Decision Notice on 31.01.2019.

Procurement Advice obtained: Urban Vision Partnership was procured through a fully compliant OJEU process.  The services outlined within the report are delivered under the exclusivity agreement in line with the Council’s contractual standing orders.

Salford City Council - Record of Decision

I, Councillor Derek Antrobus, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby authorise the making of the Traffic Regulation Order to introduce ‘ CITY OF SALFORD Hankinson Way/Rossall Way Area, Pendleton Order 2019.’

The Reasons are:

A scheme has been identified for the Salford Shopping Centre area, bounded by Hankinson Way, Rossall Way and Pendleton Way in Pendleton to improve the highway infrastructure, layout and road safety for buses, general traffic, cyclists and pedestrians.

This scheme seeks to introduce measures such as improved bus stop arrangements, wider footways and improved crossing facilities for pedestrians and a 20mph Speed Limit with associated traffic calming measures to improve road safety in the Hankinson Way, Rossall Way area.

Assessment of Risk: None  

The proposed improvements including 20mph Speed Limit Zone will make the highway network and surrounding area more accessible for all road users.

The source of funding is– Funding for the improvements has been supported by Central Government through the Greater Manchester Growth Deal

The Reasons are:

To facilitate continuous improvement of the highway drainage infrastructure as part of the defined Network Recovery Plan as part of the ongoing rolling programme of drainage repair works

Options considered and rejected were: No other options were considered for this report.

Assessment of Risk:

Medium – It is important that the existing highway drainage infrastructure improvements continue in order to ensure that surface flooding is minimised and that the capacity of existing systems is maximised, especially in view of the recent weather conditions that have been experienced within the City.
