Salford City Council - Record of Decision
I, Councillor
Derek Antrobus, Lead Member for Planning and Sustainable
Development, in exercise of the powers contained within the Council
Constitution, do hereby:
1.
Overrule the objections in respect Lynton Road and
Station Road.
2.
Accede to the objections in part in respect of Lowry
Drive.
3.
Approve the modified proposals for Lowry Drive at
the junction with Station Road set out in this report.
4.
Authorise the making of the Traffic Regulation Order
City of Salford (Lynton Road, Lowry Drive and Station
Road, Pendlebury) (Prohibition and Restriction of Waiting and
Amendment) Order 2018 in modified form set out in the
Report.
The Reasons are: That the necessary
action be taken under the Road Traffic Regulation Act 1984 to
advertise the intention to make the Traffic Order to introduce ‘No Waiting At Any Time’ and ‘No
Waiting Monday – Friday 9am – 4pm restrictions on
Lynton Road as advertise for a relaxation of waiting
restrictions. ‘No Waiting Monday
– Friday 7am – 7pm on Lowry Drive and Station Road to
maintain road safety during the day due to the
objections.
Assessment of Risk: Implementation of
the restrictions would decrease the risk of collisions and improve
access on Lowry Drive/Station Road and would provide more parking
possibilities on Lynton Road while access and safety would be still
maintained.
The source of funding: to be met from
the Block 3 Highways Capital allocation of the Swinton &
Pendlebury devolved budget carried forward from the 2017/18
financial year.
Legal
Advice obtained: Regulation 14 of The
Local Authorities’ Traffic Orders (Procedure)(England and
Wales) Regulations 1996 provides that an order making authority may
modify an order whether in consequence of any objections or
otherwise before it is made. Where the
modification is a ‘substantial change’ the authority
must inform the persons likely to be affected by the modifications
and consider any representations. The
modified proposals are not considered a ‘substantial
change’ in the context of the overall scale and purpose of
the scheme.
