City of Salford (Nightingale Gardens, Salford) (Prohibition of Waiting) Order 2022

 

I, Councillor Mike McCusker, Lead Member for Planning & Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:

 

Approve the modifications to the scheme, as set out in the report, and authorise the making of the Traffic Regulation Order in the modified form.

 

The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce City of Salford (Nightingale Gardens, Salford)(Prohibition of Waiting) Order 2022 and City of Salford (Nightingale Gardens, Salford) (20mph Speed Limit) Order 2022.

 

Assessment of Risk: Implementation of the restrictions would ensure safe access to the new development therefore maintaining highway safety,

·         By preventing vehicles parking too close to the junction and opposite, which would severely impact access for larger vehicles, and visibility sightlines.

·         The proposals will also provide a suitable speed limit for the residential area. 

 

The source of funding: The scheme is being funded by the developer.

 

Legal Advice obtained: The Council, by virtue of the Road Traffic Regulation Act 1984 can introduce orders to manage traffic. Where Traffic Regulation Orders are required, they should not give rise to any particular legal implications provided the works and procedures are carried out in accordance with the relevant statutory requirements, which would include the consideration of any objections to a proposed Traffic Regulation Order.

 

Financial Advice obtained: None – Developer to fund.

 

Procurement Advice obtained: There are no procurement implications contained within this report.

I, Councillor Mike McCusker, Lead Member for Planning & Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:

 

Authorise the permanent making of the Traffic Regulation Orders in the form given in the Notice of Proposals and as set out in the Report.

 

The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce City of Salford (Chapel Street, Ordsall) (One Way Traffic with Contra Flow Bus Lane) Order 2022 and Salford City Council (Victoria Bridge Street, Salford) (Revocation of One-Way Order, Introduction of Weight Limit and Prohibition of Right Turn) Order 2013 (Amendment) Order 2022 as permanent Traffic Orders. Implementation of the restrictions would create more reliable bus journey times; have a positive impact on environmental air quality; and promote a safer environment for the public to walk and cycle.

 

Assessment of Risk: The restrictions have been marked out in accordance with the Traffic Signs Manual and Traffic Sign Regulations and General Directions 2016. A Bus Lane Technical File has also been produced to verify the design of the scheme meets the required standards.

 

The source of funding: The scheme has been funded by the Department for Transport’s Emergency Active Travel (EAT) fund in the 2020/21 financial year. 

 

Legal Advice obtained: The Council, by virtue of the Road Traffic Regulation Act 1984, can introduce orders to manage traffic. Where Traffic Regulation Orders are required, they should not give rise to any particular legal implications, provided the works and procedures are carried out in accordance with the relevant statutory requirements, which would include the consideration of any objections to a proposed order.

I, Councillor Mike McCusker, Lead Member for Planning & Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby:

 

Authorise the making of the Traffic Regulation Order in the form given in the Notice of Proposals

 

The Reasons are:

That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Orders to introduce: ‘City of Salford (South Avenue/Folly Lane, Swinton) (Prohibition of Waiting) Order 2016 (Amendment) Order 2022’ to keep the area and sole footway clear of parked vehicles, improving accessibility and visibility to the area.  This matter was previously considered at the Lead Member Briefing for Planning & Sustainable Development held on 16th November 2021 – this is a correction to the Record of Decision that was published following that meeting.

 

Assessment of Risk:

The restrictions will be marked out in accordance with the Traffic Signs Manual and Traffic Sign Regulations and General Directions. (TSRGD 2016).

Decision:

Salford City Council - Record of Decision

 

I, Councillor Mike McCusker, Lead Member for Planning and Sustainable Development, in exercise of the powers contained within the Council Constitution, do hereby approve:

 

The expenditure of £303,331.92 of Section 106 contributions towards Parr Fold Park.

 

The reasons are to meet the requirement of the relevant Section 106 Agreement detailed within the report.

 

Options considered and rejected:  Not applicable as the Section 106 Agreement detailed within the report requires expenditure on specific individual projects or types of projects.

 

Assessment of risk: Low – The delivery of these open space improvements will satisfy the terms of the Section 106 agreement.

 

The source of funding is Section 106 contributions totalling £303,331.92, which have been received from the developments located at:

 

§  £263,509.79 from High Point at Hilton Lane (Section 106 Ref: 402 – planning application 19/73971/FUL),

§  £39,822.13 from the Old Co-Op Buildings, Walkden (Section 106 Ref: 417 – planning application 19/74442/FUL).

 

Legal Advice obtained:The Section 106 contributions can only be invested into the mitigation of open space in accordance with the respective Section 106 agreements. This project is considered to be an appropriate use of funding on the basis that Parr Fold Park is a named project for the open space contributions in both the relevant agreements.

 

Financial Advice obtained: The £303,331.92 Section 106 funding as identified in the report has been received and is available to fund the works.

 

Procurement Advice obtained: Not applicable
